Grounds for Khula

Non-support – If the husband fails to provide for the wife’s maintenance or support for two years or more, the wife can file for khula.
Imprisonment – if the husband is imprisoned for at least seven years then the wife can file khula to dissolve the marriage.
Procedure of Khula in Pakistan
The procedure for obtaining khula in Pakistan involves the following steps:
The wife will have to file a petition in the relevant family court, stating the grounds for seeking khula and providing details about the marriage.
The court will send a notice to the husband, informing him about the petition and the grounds on which khula is being sought.
The court will make efforts to reconcile the parties and settle the dispute amicably.
If reconciliation efforts fail, the court will hear the case and decide whether to grant khula. If the court is satisfied that the grounds for khula are valid, it will issue a decree dissolving the marriage.
The attested copy of the court decision will be submitted to the relevant Union Council.
Union Council will send a notice to the husband and try again for reconciliation between both parties
If reconciliation efforts fail, the union council will issue a marriage dissolution certificate to both parties.
Required Documents
To file for khula in Pakistan, the wife will need to provide the following documents:
CNIC: A copy of wife’s national identity card (CNIC).
Nikahnama: A copy of the marriage contract or Nikahnama.
Two Witnesses: The wife may also need to provide witness statements from family or friends who can attest to the grounds for khula.

For overseas Pakistanis, the procedure for obtaining khula is similar to that for residents of Pakistan. However, there may be some additional steps and considerations to keep in mind.
She must submit a specific power of attorney before appointing someone as her personal representative or attorney. This power of attorney will be certified by the Pakistani embassy or high commission in the nation where she will be staying. It needs to be certified by Pakistan’s Ministry of Foreign Affairs.

The personal representative can then file a case and represent the wife in a family court proceeding through an attorney to get a khula decree.
The special counsel can begin the arbitration council action for obtaining the divorce certificate after receiving the Khula decree. Remember that the foreign wife has permission to appear and proceed in the arbitration through a special power of attorney.
